Party A: Zhejiang ShiningHub Co., Ltd.

为明确甲、乙双方责任与义务，根据中华人民共和国有关法律、法规，本着平等自愿的原则，经甲乙双方协商一致，签订本协议。

This agreement is made between party A and party B after friendly consultation according to corresponding laws, rules and regulations of the People’s Republic of China.

一、 兼职期限及工作时间

1.       Part-time Service period and working hours

乙方到甲方从事兼职工作，时间自_________年_______月_______日起至_________年_______月_______日止，

根据甲、乙双方协商一致，工作时间为                                         。

二、 兼职岗位

2.       Position

甲方根据乙方的实际情况和工作需要，安排乙方到_________部门，从事                    工作。

Party B shall join in              Department according to the resource requirement and party B’s skills.

三、 兼职报酬

3.       Salary

依照按劳取酬的原则，按甲方现行制度确定乙方的兼职薪酬按月支付，杭州公司法律顾问每月人民币_________元。如发生岗位变动，甲、乙双方需协商后相应调整兼职薪酬。

Party A shall pay Party B RMB        Yuan on a monthly basis. The salary shall be adjusted after consultation process if there’s re-arrangement about Part B’s position.

四、 乙方在兼职期间应遵守以下规定

4. Party B shall obey below rules:

1）．乙方应遵守国家的法律法规；遵守甲方的各项规章制度。如违反国家法规和企业的规章制度，甲方可以根据情节轻重给予必要的处分或终止兼职协议。

       1)  Party B shall obey laws of the People’s Republic of China. Party B shall obey corresponding rules and regulations of party A. Any violation may lead to corresponding discipline or agreement termination if necessary.

2）．因乙方造成的甲方财物损失的，按甲方规定处理。

2)  Party B shall follow party A’s process and regulations for the cases like the property loss caused by party B.

五、劳动保护

5. Labor protection and working condition

　　1）．甲方需为乙方提供符合国家规定的安全卫生的工作环境，保证其在人身安全不受危害的环境条件下工作。

       1)  Party A shall provide Party B with occupational safety and healthy working conditions

2）．甲方根据乙方岗位实际情况，按国家规定向其提供必需的劳动防护用品。

2)  Party A shall provide relevant protective equipment according to party A’s work condition according to laws of the People’s Republic of China.

3.甲乙双方约定，乙方自行购买意外伤害保险，杭州劳动纠纷律师乙方在为甲方提供劳务过程中发生意外伤害均与甲方无关。

3)Both parties agree that Party B to purchase their own accident insurance, providing services for Party B in the course of an accident related injuries aren’t related to Party A.

六、协议解除

       6. Termination

乙方在本协议履行期间可以在说明原因的情况下向甲方提出终止兼职协议，但必须提前7天通知甲方，并作好工作交接，否则应承担相关责任。兼职期间，甲方如发现乙方不符合工作要求或不适宜甲方安排工作等情况的，可以向乙方提出终止协议，在为乙方履行兼职报酬支付手续后，解除本协议。

This agreement may be terminated as follows:

Party B shall notice party A 7 days in advance with reasons and the agreement can be terminated. If party B is not qualified during the work, the agreement can be terminated after payment is completed.

七、未尽事宜由双方及时协商解决。

7. Any disputes arising from the execution of the agreement shall be settled through friendly consultations between both parties.

八、争议的解决

8．Dispute Resolution

因本协议引起的或与本协议有关的任何争议，应提前协商解决，如协商不成，在当地仲裁机构进行仲裁。仲裁裁决是终局的，对双方均有约束力。

Of this Agreement arising out of or relating to this agreement, any dispute should be resolved through consultation in advance, such as the negotiation fails, the local arbitration institutions for arbitration. The arbitral award is final and binding on both parties.

九、法律效力

9. Legal validity

本协议正本一式二份，双方各执一份，经甲乙双方签字后生效。

This agreement shall take effect after it is signed by both parties.
